General Terms and Conditions (GTC)

These General Terms and Conditions (hereinafter "Terms") apply to all contracts regarding the use of the Software-as-a-Service (SaaS) application "Scrapy Coco" concluded between

(hereinafter "Provider")
and the customer (hereinafter "Customer").
The offer is aimed at both consumers (Section 13 BGB) and entrepreneurs (Section 14 BGB).
2. Subject matter of the contract
The Provider makes available to the Customer web-based software with which the ranking of products on Amazon (SERP tracking) can be monitored.
Important notice regarding data availability: The software analyzes publicly available data on Amazon. The Provider has no influence on the technical design of the Amazon platform. Should Amazon make technical changes that make reading the data more difficult or impossible (e.g., CAPTCHAs, layout changes), the Provider does not guarantee successful data collection but will endeavor to restore functionality in a timely manner.
A guarantee for permanent, uninterrupted availability of the services cannot be given for technical reasons. Availability is 98% on an annual average.
3. Conclusion of contract & registration
Use of the service requires registration. By completing the order process (clicking on "Order with obligation to pay" or similar buttons), the Customer submits a binding offer.
The contract is only concluded upon activation of the account or confirmation via email.
4. Prices and terms of payment
The prices indicated on the website at the time of the order apply. The indicated prices are final prices. Due to the small business status according to § 19 UStG (German VAT Act), the seller does not charge VAT and therefore does not show it.
Payment is made via the service provider Stripe. The usage fee is due in advance for the selected billing period (monthly or yearly).
5. Term and termination
Subscriptions renew automatically for the selected period (e.g., 1 month) unless cancelled before the end of the current period.
Cancellation is possible at any time via the account settings in the web app ("Settings" -> "Subscription") and becomes effective at the end of the current term.
6. Right of withdrawal for consumers
If you are a consumer (i.e., a natural person who enters into the legal transaction for purposes that are predominantly outside their trade, business, or profession), you are entitled to a right of withdrawal in accordance with statutory provisions.
Expiry of the right of withdrawal for digital content
The right of withdrawal expires in the case of a contract for the supply of digital content not on a tangible medium if the Provider has begun performing the contract after the consumer has:
- expressly agreed that the Provider shall begin performing the contract before the expiry of the withdrawal period, and
- confirmed their knowledge that they lose their right of withdrawal by consenting to the commencement of the execution of the contract.
Since Scrapy Coco grants you access to the software and data immediately after purchase, you agree to this premature expiry of the right of withdrawal during the ordering process.
7. Liability
The Provider is liable without limitation in cases of intent and gross negligence. In cases of slight negligence, the Provider is only liable for the breach of material contractual obligations (cardinal obligations), but limited to the foreseeable damage typical for the contract.
The Provider is only liable for the loss of data if the Customer has ensured through regular backups that this data can be reconstructed with reasonable effort.
8. Final provisions
The law of the Federal Republic of Germany applies.
The place of jurisdiction is, as far as legally permissible, the registered office of the Provider.
9. Nutzungsbeschränkungen & Wettbewerbsverbot
1. Die Nutzung von Scrapy Coco durch Unternehmen, die in einem direkten Wettbewerbsverhältnis zum Anbieter stehen oder im Auftrag solcher handeln, sowie die systematische Erhebung von Daten zum Zwecke der Konkurrenzanalyse, des Reverse Engineering oder der Entwicklung konkurrierender Produkte ist untersagt.
2. Die durch die Software generierten Berichte und Datenausgaben sind ausschließlich für die Eigenverwendung des Kunden bestimmt. Eine Weitergabe an Dritte zum Zwecke des Aufbaus konkurrierender Dienste ist untersagt.
3. Im Falle eines Verstoßes oder des begründeten Verdachts auf missbräuchliche Nutzung durch Mitbewerber behält sich der Anbieter das Recht vor, den Zugang fristlos zu sperren und rechtliche Schritte nach dem UWG (Gesetz gegen den unlauteren Wettbewerb) einzuleiten.
